About Family-Sponsored Visas
Family-sponsored visas are available to immediate relatives of U.S. citizens or those who have lawful permanent resident status in the United States. An immediate relative — a spouse, parent or adult child — who wants his or her loved one to come live with them in the United States must sponsor that person to become a green card holder. The sponsor must also prove that they have enough income or assets to support their loved one in the United States.
There are several different circumstances where this can work. In cases where a foreign national marries a U.S. citizen or where an adult U.S. citizen has foreign national parents, then the U.S. citizen may petition for that spouse or parent to become a green card holder.
A spouse married to a legal permanent resident or an adult U.S. citizen petitioning for an adult son or daughter may also lead to a foreign national obtaining a green card. In those cases, however, the foreign national will need to be on a waiting list that is often quite long.
Eligibility for the green card can be affected if the foreign national has a criminal record, a record of misrepresentation when dealing with immigration authorities or who did not enter into the country legally.
